Host: What are the three gremlins of estate planning?

William Conway: Well, the three problems that we are concerned about are what I call the three gremlins of estate planning. Those three gremlins are number one, the inability to direct the property in the matter that I wanted to go, number two, the process of probate itself and number three, the possibility of guardianship or conservatorship which we sometimes call living probate. The last two are circumstances were the court can and will take control of the assets of the person who is incapacitated or passed away and the other is of course, taxation and people would like to avoid paying anymore tax than whatever is absolutely necessary.
