Host: Why are cigarettes available if they contain harmful ingredients?

Eletta Hansen: The tobacco industry is not regulated by any governmental agency, this has been tried in the courts, some of you may remember the 1998 case against the tobacco industry in which the Supreme court decided that yes, the tobacco industry should be regulated, but because the industry predated governmental regulatory agencies like the FDA, the Supreme Court decided that a congressional vote would be required. There was a lot of interest in having that pass, however the vote failed on congressional floor and the tobacco industry remains unregulated today.
